"Israel Hayom" cannot use "Maariv" digital archive

The Jerusalem District Court ruled in favor of "Ma'ariv" owned by the Jerusalem Post Group.

Nrg will receive only the website's digital archive and not the digital content of the entire "Ma'ariv" newspaper, Jerusalem District Court Judge David Mintz ruled today. In doing so he accepted the position of "Ma'ariv" owned by the Jerusalem Post Group over the claims of the "Israel Hayom" Hebrew daily, owned by Sheldon Adelson.

The judge ruled that "Ma'ariv's" trustee will immediately receive the digital file with all the pictures published on nrg that once belonged to the newspaper and is today held by "Israel Hayom," and that the site will only be able to use these pictures.

The judge also ruled that nrg will delete any reference to "Ma'ariv" from the date on which it was acquired by "Israel Hayom" but need not delete references prior to that date.

"Maariv" submitted its request in a case that the two sides had been pursuing for over a year. "Israel Hayom," which purchased the nrg archive, sought to continue its use of "Maariv's" entire digital archive, claiming that it purchased access to "all of 'Maariv's' digital assets," including the digital archives, even though these were used in "Maariv's" printed edition.

The "Jerusalem Post" Group, which acquired the printed "Maariv" newspaper, asserted that the sale agreement for the liquidated newspaper allowed "Israel Hayom" to use only the digital archive of the website it acquired. According to the "Jerusalem Post," "Maariv's" complete archive contains four million pictures, of which nrg has used only 200,000 - those found in the nrg archive.
